TIME AND PLACE OF MEETING
The regular meeting of the Cranbury Township Zoning Board of Adjustment was held at the Township Hall (Old School Building) Main Meeting Room, 23-A North Main Street, Cranbury, New Jersey, on June 6, 2007, at 7:30 p.m.
CALL TO ORDER
Dale Smith, Chairperson, of the Cranbury Township Planning Board, called the meeting to order and acted as the Chairman thereof, and, Josette C. Kratz acted as Secretary of the meeting.
STATEMENT OF ADEQUATE NOTICE
Pursuant of the Sunshine Law adequate notice in accordance with the Open Public Meetings Act was provided of this meeting’s date, time, place and agenda was mailed to the news media, posted on the Township’s Bulletin Board, mailed to those requesting personal notice, and filed with the municipal clerk.

Ms. Bauder asked that the there be a time limit in which the applicant is required to complete the landscaping. Mr. Smith commented also that it was brought to his attention that application received approvals for another fence and a pool and failed to notify the Board of such during their hearing. He indicated that he would look into this further with Jeff Graydon.

Having given proper notice and sworn the Board had jurisdiction to hear the matter. Ms. Marcelli was also sworn.
Mr. Mathur explained that ľ’s of his lot bordered a road and he was fencing in a portion of the rear, extending into the setbacks to give more space for the children and dog to play.

The fence would be similar to the neighbors fence shown in the pictures and would be no higher then the neighbors fence. He was told that he would have to receive approval from the Township Committee as a condition of the approval to allow encroachment into the drainage easement and would also have to gate the two ends of that easement for access if needed.

Mr. Shea motioned for the approval of the fence variance. Mr. McCarville seconded the motion.

Having given proper notice and sworn the Board had jurisdiction to hear the matter. Ms. Marcelli was also sworn.
Mr. Diamond explained that he wanted to erect a three board, four foot high fence with a slanted horizontal top piece to enclose an area for his dogs and to enhance the agricultural appearance of the property. He had no intention of using the area for horses.
No members of the public made comment.
Mr. McCarville motioned for the approval of the fence application. Mr. Shea seconded the motion.

There are outstanding or other mitigating issues with the adjacent property that related to the development of this property that without the adjacent owner present to testify the board was concerned about actual authority to take jurisdiction to hear this matter at this time.
Mr. Balint did request, that since notice was given, that the Board grant an extension of time for the sign variance to exceed the one year and run for the length appropriate for the preliminary and final site plan approval time limits.
Mr. McCarville motioned for the approval of the extension of time. Mr. Patterson seconded the motion.

Ms. Marcelli mentioned that the applicant could made changes to the detention facility so that it did not affect changes on the adjacent property which would eliminate the need the involvement of the adjacent property.
The Applicant said that they would look into that and carry their application to July 11, 2007 without further notice in order to address the outstanding issues with regard to the adjacent property owner’s involvement.
ADJOURNMENT OF MEETING
There being no further business, on a motion duly made, seconded, and carried, the meeting was thereupon adjourned.
