TOWNSHIP COMMITTEE MEETING

SEPTEMBER 20, 2004

 

 

The regular meeting of the Township Committee of the Township of Cranbury was held at 7:30 p.m. in the Town Hall Meeting Room.  Answering present to the roll call were:  Township Committee members:  Becky Beauregard, Thomas Panconi, Jr. and Mayor Stannard.  Mr. Mayes arrived at 7:50 p.m. Also present were:  Trishka Waterbury, Esquire, Attorney, Cathleen Marcelli, Engineer, Frederick C. Carr, Administrator and Kathleen R. Cunningham, Clerk.  Mayor Stannard led in the salute to the flag and Ms. Cunningham gave the following Open Public Meetings Act statement:

 

In accordance with Section 5 of the Open Public Meetings Act, it is hereby announced and shall be entered into the minutes of this meeting that adequate notice of this meeting has been provided:

 

(1)                 Posted on December 2, 2003 on the Bulletin Board of the Municipal

Office at 23-A North Main Street, Cranbury, New Jersey and remains posted at that location.

 

(2)                 Communicated to the Cranbury Press, Home News Tribune and Trenton Times on December 2, 2003.

 

(3)                 Was filed on December 2, 2003 with a Deputy Municipal Clerk at the Cranbury Municipal Office, 23-A North Main Street, Cranbury, New Jersey and remains on file for public inspection, and

 

(4)                 Sent to those individuals who have requested personal notice.

--Committee Minutes 13 September 2004

            On motion by Mr. Panconi, seconded by Ms. Beauregard and unanimously carried, (Mr. Mayes and Ms. Stave were absent) the minutes of September 13, 2004 were adopted.

 

--Sub Committee Reports –

            Mr. Panconi reported that the Police Contract Negotiations SubCommittee had met with the police on Friday, September 17, 2004 and plan to meet again this Friday, September 24, 2004.  Mayor Stannard reported that progress is being made.

           

Agenda Additions/Changes

            Mr. Panconi indicated he had received a letter from the Fire Marshall, Joseph Seip, requesting a vehicle.  Mr. Paconi requested this issue be discussed at the end of the meeting.

Cranbury Township Resolution # R 09-04-171

 

RESOLUTION PROVIDING FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE MUNICIPAL BUDGET OF THE TOWNSHIP OF  CRANBURY PURSUANT TO N.J.S.A. 40A:4-87 (CHAPTER 159, P.L. 1948)

 

      WHEREAS, N.J.S.A. 40A: 4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and

 

     WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount,

 

     Section 1

 

     NOW, THEREFORE, BE IT RESOLVED that the Township Committee hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2004 in the sum of $6,696.83 which item is now available as a revenue from the Recycling Tonnage Grant pursuant to the provision of statute, and

 

     Section 2

 

     BE IT FURTHER RESOLVED that a like sum of $6,696.83 be and the same is hereby appropriated under the caption Recycling Tonnage Grant.

 

     Section 3

 

     BE IT FURTHER RESOLVED that a copy of the Resolution, certified by the Township Clerk to be a true copy, be forwarded to each of the following:

 

(a)                 Director of the Division of Local Government Services

(b)                 Township Auditor

(c)                 Township Chief Financial Officer

Cranbury Township Resolution # R 09-04-172

 

Whereas, pursuant to a duly advertised Notice to Bidders, the Township of Cranbury received seven (7) bids on August 25, 2004, for the demolition of the Wrights Roses Facility, and

 

Whereas, the apparent low bidder was Bojan Developments, LLC, 120 Greylock Avenue, Belleville, New Jersey07109, with a bid for $ 132,787.50, and

Whereas, the Township of Cranbury received a letter, dated August 25, 2004, from the second low bidder, Site Contractors, Inc., protesting an award of the contract to Bojan Developments, and

Whereas, the Township Engineer’s Office, on consultation with the Township Attorney’s Office, has reviewed Site Contractors, Inc.’s letter of protest and determined it to be unfounded, and

 

Whereas, the most responsible and lowest bidder is Bojan Developments, LLC, 120 Greylock Avenue, Belleville, New Jersey 07109, with a bid in the amount of $132,787.50, and

 

Whereas, the Chief Financial Officer has certified that there are sufficient funds available for this purchase,

 

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Cranbury, in the County of Middlesex, as follows:

 

            1.         The contract is hereby awarded to Bojan Developments, LLC, 120 Greylock Avenue, Belleville, New Jersey 07109, as the lowest responsible bidder.

 

            2.  The Mayor and Clerk are hereby authorized and directed to execute an agreement with Bojan Developments, LLC, 120 Greylock Avenue, Bellevile, New Jersey 07109 for the Demolition of the Wrights Roses Facility, in the amount of $ 132,787.50.

 

            3.  That a certified coy of this Resolution be sent to:

 

                        1. Bojan Developments, LLC

                        2.  Township Engineer

                        3.  Township Chief Financial Officer

Work Session

 

a.       Eagle Scout Project (Gregory Bredariol)

      Mr. Bredariol presented a proposal to the Township Committee to design and         build a fence along the North Side of the access   road going on to the West           Property.  This project has been approved by both HPAC and the Environmental    Commission.  The Township Committee unanimously endorsed Mr. Bredariol’s       proposal.

 

b.       Temporary Athletic Fields          

      The Township Committee discussed the possible temporary locations for   Soccer and other athletic fields. Ms. Beth Veghte, Chairperson for the       Recreation Board, spoke in favor of having the temporary location at the Heritage      Park.  Ms. Judy Dossin, Parks Board Chairperson, however, spoke against this      site, indicating this Park is an alternative recreational park and many residents     would be upset.  Ms. Dossin also indicated there is a continuing need and             pressure for more active recreation sites and the park system is reaching its       outer limits.  Ms. Dossin also suggested having “banked” future park space in the   Township.  Ms. Beauregard recommended waiting until the School Board

                        approaches the Township Committee, which they have not done.  Ms.                   

                        Beauregard also recommended calling Mr. Schraudenbach, who is on the School               Board, to request a meeting with members of the Township Committee to                               discuss this issue.  Mayor Stannard indicated he will make the call.   

 

2.                   Public Comment

            The Mayor opened the meeting to public questions and comments on those items not on the agenda.  Ms. Beth Veghte, Recreation Chairperson, indicated the Needs Assessment Questionnaire is finished and going out in the mail.  There being no further comments, the Mayor closed the public part of the meeting.

 

Mayor’s Notes

            Mayor Stannard indicated Cranbury Day was a success and the weather was great!

 

            Mayor Stannard indicated that he had received a letter from Sue Leson, volunteering to be on the Wright/South Baseball Field SubCommittee.

 

The Township Committee discussed the issue of a letter from the Fire Marshall, requesting his own vehicle.  It was suggested giving the Fire Marshall a used Township vehicle, as he only works for the Township a total of nine (9) hours a week.  Mr. Carr, Township Administrator, has sought the advice of Mr. Ed Konin, Esquire, whether or not the Township is compelled to let the Fire Marshall have his own vehicle.  Mr. Konin will get back to the Township Committee.

RESOLUTION TO CLOSE MEETING TO THE PUBLIC

 

            BE IT RESOLVED by the Township Committee of the Township of Cranbury, Middlesex County, New Jersey as follows:

 

            The Township Committee will now convene in a closed session that will be limited only to consideration of items with respect to which the public may be excluded pursuant to Section 7B of the Open Public Meetings Act, P.L. 1975, c. 231.

 

            1.         The general nature of the subject to be discussed in this session is as follows:

 

                        ----Litigation: Fischer Acres Condemnation

                        ----Closed Session Committee Minutes of September 13, 2004.

            2.         It is unknown at this time precisely when the matters discussed in this session will be disclosed to the public.  Matters involving contract negotiations or the acquisition of land will be disclosed upon conclusion of the negotiations or upon approval of the acquisition.  Matters involving personnel will be disclosed when the need for confidentiality no longer exists.  Matters concerning litigation will be announced upon the

conclusion of trial or settlement of that litigation or when the need for confidentiality no longer exists.

On motion by Mr. Mayes, seconded by Mr. Panconi and unanimously carried, the Closed Session minutes of September 13, 2004 were adopted.

 

The Township Committee discussed the process for responding to a confidential letter written to the Township Committee by an employee recently.  Ms. Beauregard, as a member of the Personnel SubCommittee will let the employee know that the Township Committee has the letter and the employee will receive a Rice Notice for the next meeting so the Township Committee may discuss the matter.  The Township Committee unanimously agreed, employees should have the opportunity to go to the Personnel SubCommittee, should he/she decide they are not getting an adequate response.

 

Mr. Panconi asked the status of the “Cost of Living Increases” for Township Employees.  Mr. Carr indicated that since he had furnished the Township Committee with additional information they requested, he has not received any directive from the Township Committee.  Mr. Mayes indicated the Township Committee should wait until Ms. Stave is present to discuss this issue, as she had previously raised some questions.  The Township Committee will discuss this issue at the next meeting on September 27, 2004.
