TOWNSHIP COMMITTEE MEETING

MAY 17, 2004

 

 

The regular meeting of the Township Committee of the Township of Cranbury was held at 7:30 p.m. in the Town Hall Meeting Room.  Answering present to the roll call were:  Township Committee members:  Becky Beauregard, Michael Mayes,  Thomas Panconi, Jr., Pari Stave and Mayor Stannard.  Also present were:  Edmond M. Konin, Esquire, Attorney (filling in for Trishka Waterbury), Cathleen Marcelli, Engineer, Frederick C. Carr, Administrator and Kathleen R. Cunningham, Clerk.  Mayor Stannard led in the salute to the flag and Ms. Cunningham gave the following Open Public Meetings Act statement:

 

In accordance with Section 5 of the Open Public Meetings Act, it is hereby announced and shall be entered into the minutes of this meeting that adequate notice of this meeting has been provided:

 

(1)                 Posted on December 2, 2003 on the Bulletin Board of the Municipal

Office at 23-A North Main Street, Cranbury, New Jersey and remains posted at that location.

Mayor Stannard welcomed the Boy Scouts who were attending the meeting as part of their Merit Badge Project.

            On motion by Mr. Mayes, seconded by Ms. Beauregard and unanimously carried the minutes of May 3, 2004 were adopted.

 

--Sub Committee Reports

            Mr. Panconi reported that he had attended a meeting with Harvey Moskowitz, Planner, Cathleen Marcelli, Township Engineer and Ms. Stave concerning a location for the Public Works storage facility.

 

            Mr. Panconi also reported progress is being made on the Police Contract Negotiations at a slow pace.

RESOLUTION OF THE TOWNSHIP OF CRANBURY, NJ

 

A RESOLUTION APPROVING THE APPRAISALS PREPARED BY PETER E. SOCKLER, MAI, FOR PERMANENT SIDEWALK EASEMENTS ACROSS BLOCK 23, LOTS 93, 107, 110, 111, 117 AND 118 IN THE TOWNSHIP OF CRANBURY, TO FACILITATE THE CONSTRUCTION OF THE CRANBURY NECK ROAD SIDEWALK.

 

WHEREAS, on April 19, 2004, the Township Committee of the Township of Cranbury adopted Ordinance 03-04-11 authorizing the acquisition for public use, by purchase, gift, or condemnation, of permanent sidewalk easements across Block 23, Lots 93, 107, 110, 111, 117 and 118 in the Township of Cranbury; and

 

WHEREAS,  the Township has obtained from Peter E. Sockler, MAI an appraisal of each property interest sought to be acquired (collectively, the “appraisals”); and

 

WHEREAS, said appraisals, using the Sales Comparison approach, have established a fair market value for each of the property interests to be acquired;

 

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Cranbury as follows:

 

            1.         The following appraisals prepared by Peter E. Sockler, MAI are hereby approved:

 

A.         Summary Appraisal Report of a Permanent Sidewalk Easement Located at Block 23, Lot 93, 8 Cranbury Neck Road, Township of Cranbury, Middlesex County, New Jersey as of April 15, 2004 ($2,313.00).

 

B.         Summary Appraisal Report of a Permanent Sidewalk Easement Located at Block 23, Lot 107, 12 Cranbury Neck Road, Township of Cranbury, Middlesex County, New Jersey as of April 15, 2004 ($1,904.00).

 

C.         Summary Appraisal Report of a Permanent Sidewalk Easement Located at Block 23, Lot 110, 14 Cranbury Neck Road, Township of Cranbury, Middlesex County, New Jersey as of April 15, 2004 ($3,132.00).

F.         Summary Appraisal Report of a Permanent Sidewalk Easement Located at Block 23, Lot 118, 22 Cranbury Neck Road, Township of Cranbury, Middlesex County, New Jersey as of April 15, 2004 ($1,814.00).

 

            2.         The amount of just compensation set forth in each of the above-approved appraisals may be used as the basis for any offer of compensation extended to

                        the owners of the property interests sought to be acquired.  The total amount of the negotiated amounts shall not exceed $14,000.00.

WHEREAS, there is a need for certified shorthand reporting services for the Township of Cranbury on an ongoing basis, and

 

WHEREAS, M. Virginia Guinta, Certified Shorthand Reporter, has submitted a proposed contract for providing these services at rates noted in the attached document, and

 

WHEREAS, funds are available for this purpose, and

 

WHEREAS, the Local Public Contract Law (N.J.S.A. 40:11-1 et. seq.) requires that the Resolution authorizing the award of the contracts for professional services without competitive bids must be publicly advertised if in excess of the bid limit;

 

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Cranbury that the:

 

            1.         Mayor and Clerk of the Township of Cranbury are hereby authorized and directed    to execute the attached Agreement with M. Virginia Guinta, Certified Shorthand Reporter,   services for the year 2004, as set forth in said Contract, which is available for inspection            at the Office of the Township Clerk.

 

            2.         This Contract is awarded without competitive bidding as a “professional service”      under the provisions of the Local Public Contract Law, inasmuch as said Agreement is for      services to be performed by persons authorized by law to practice a recognized     profession which is not susceptible to competitive bidding and is of a qualitative nature.

 

            3.         A notice regarding the award of the Contract shall be published in the Cranbury       Press within ten (10) days after passage of same if the Contract will exceed the bid limit.

WHEREAS, the Local Public Contract Law (N.J.S.A. 40:11-1 et. seq.) requires that the Resolution authorizing the award of the contracts for professional services without competitive bids must be publicly advertised if in excess of the bid limit;

 

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Cranbury that the:

 

1.         Mayor and Clerk of the Township of Cranbury are hereby authorized and directed to execute the attached Agreement with Harvey S. Cranbury Township Resolution # R 05-04-104

 

            WHEREAS, there exists a need for a study to be performed to investigate the extension of Liberty Way (the Master Plan Roadway) south from Station Road to a signalized intersection with Route 130 at Old Trenton Road, as well as perform a review of various traffic issues facing the Township of Cranbury, and

 

            WHEREAS, the Planning Board of the Township of Cranbury has recommended that the Township of Cranbury obtain the services of Shropshire Associates, LLC, and       

 

            WHEREAS, Shropshire Associates, LLC has submitted a professional services proposal to provide traffic engineering services to Cranbury Township to perform these studies,

 

            WHEREAS, funds are available for this purpose, and

 

            WHEREAS, the Local Public Contract Law (N.J.S.A. 40:11-1 et. seq.) requires that the Resolution awarding the award of the contracts for professional services without competitive bids must be publicly advertised if in excess of the bid limit;

 

            NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Cranbury that the:

 

            1.         Mayor and Clerk of the Township of Cranbury are hereby authorized and     directed to execute the attached Agreement with Shropshire Associates, LLC for    traffic engineering services for the year 2004, as set forth in said Contract, which is available for inspection at the Office of the Township Clerk.

 

            2.         This Contract is awarded without competitive bidding as a “professional      service” under the provisions of the Local Public Contract Law, inasmuch as said       Agreement is for services to be performed by persons authorized by law to practice a recognized professional which is not susceptible to competitive bidding   and is of a qualitative nature.

 

            3.         A notice regarding the award of the Contract shall be published in the Cranbury Press within ten (10) days after passage of same if the Contract will exceed the bid limit.

Work Session

 

a.       Proposed Booklet

                        Presentation by Betty Wagner, Township Historian and Kathy                                                       Cunningham, Clerk of a proposed Cranbury Township booklet.  Ms. Wagner and                                     Ms. Cunningham presented to the Township Committee a proposed                                                 informational booklet.  Ms. Wagner would like to distribute the booklet when the                                    State Historical Society has their League Summer Meeting in Cranbury on June                             19, 2004.  Ms. Cunningham wishes to give them out to new residents of                                         Cranbury, as well as current residents.  The Township Committee reviewed the                           booklet and gave their approval.

 

b.       Drainage on Petty Road (Connie Powell)

      A discussion took place concerning the drainage problem on Petty Road.  Mr.        and Mrs. Powell, along with the Township Engineer and the Township Committee will monitor the swale.   

 

c.   Township Committee Goals and Subcommittees

      The Township Committee discussed goals for 2004 and formed Subcommittees      for various goals.

 

Public Comment

            The Mayor opened the meeting to public questions and comments on those items not on the agenda.   Mr. Richard Kallan, Wynnewood Drive asked the status of the village sidewalks and appraisals.  Mr. Kallan also asked what the Township intends to do about the plantings which someone made in the swale on Petty Road.  Ms. Marcelli responded that the violation would have to be written by the Zoning Officer.  Mr. Kallan asked the status of the violation at the new Four Seasons at Cranbury development.  Mr. Konin, Township Attorney, responded that because this matter is in litigation no one is at liberty to say.   There being no further comments, the Mayor closed the public part of the meeting.

RESOLUTION TO CLOSE MEETING TO THE PUBLIC

 

            BE IT RESOLVED by the Township Committee of the Township of Cranbury, Middlesex County, New Jersey as follows:

 

            The Township Committee will now convene in a closed session that will be limited only to consideration of items with respect to which the public may be excluded pursuant to Section 7B of the Open Public Meetings Act, P.L. 1975, c. 231.

 

            1.         The general nature of the subject to be discussed in this session is as follows:

Ms. Beauregard asked Chief Hansen to have his Department monitor motorbikes being ridden on Township property.  She has observed bikes being ridden on Township property recently.

 

Ms. Stave made a motion, seconded by Mr. Mayes and unanimously carried to amend the Police Contract concerning retirement and health benefits.

 

Mayor Stannard announced that he is appointing Deborah L. Mara VMD, to the Municipal Alliance on Drug Abuse and Alcoholism.

 

On motion by Ms. Stave, seconded by Ms. Beauregard and unanimously carried, the Closed Session Minutes of May 3, 2004 were adopted.

 

Ms. Stave recommended that trees be planted adjacent to the C.H.A. site near the tot lot to block the homeowners view of the tot lot.   The Township Committee unanimously agreed.
