TOWNSHIP COMMITTEE MEETING

AUGUST 6, 2007

 

The regular meeting of the Township Committee of the Township of Cranbury was held at 7:00 p.m. in the Town Hall Meeting Room.  Answering present to the roll call was: Township Committee members:  Thomas F. Panconi, Jr., Richard Stannard, Pari Stave and Wayne Wittman.  Mayor Stout was absent.  Also present was: Trishka Waterbury, Esquire, Attorney, Jack Coughlin, Interim Administrator and Kathleen R. Cunningham, Clerk.  Ms. Stave, Deputy Mayor, conducted the meeting.  Deputy Mayor Stave led in the salute to the flag and Ms. Cunningham gave the following Open Public Meetings Act statement:

Agenda Additions/Changes

     Ms. Cunningham, Clerk, announced a Proclamation (Item # 10 on the Agenda) would be read before going in to Closed Session and Cranbury Township Resolutions #’s R 08-07-150 and R 08-07-151 were being added at the request of Counsel.  Ms. Waterbury, Esquire, Township Attorney, gave a brief summary of both Resolutions and indicated both she and Ms. Marcelli, Township Engineer had reviewed both Agreements.  Ms. Waterbury further stated each Resolution directs both the Mayor Clerk to execute the Developer’s Agreements.

            WHEREAS, the Township of Cranbury recognizes the importance of its older residents of the Township and the necessity for programs and activities which are planned especially for the senior residents of its population; and

 

            WHEREAS, the Township of Cranbury has never had a dedicated center where its senior residents can meet, socialize and take advantage of special programs and events on an ongoing basis; and

 

            WHEREAS, all Township residents recognize the valuable contributions our seniors have made throughout their lives and continue to make; and

 

            WHEREAS, the Township of Cranbury has now dedicated the former “Recital Room” to its seniors to enjoy and call their own and to be able to enjoy programs as well as partake in various forms of recreational and stimulating events; and

 

            WHEREAS, on Saturday, September 15, 2007 the new Senior Center at Town Hall will officially open;

 

            I, DAVID J. STOUT, Mayor, hereby Proclaim on behalf of the Township Committee of the Township of Cranbury, that Saturday, September 15, 2007 be declared “Senior Citizen Day” in the Township of Cranbury and wish the new Senior Center much success.

A motion to enter an Ordinance entitled, “Cranbury Township Ordinance # 07-07-10, AN ORDINANCE OF THE TOWNSHIP OF CRANBURY, COUNTY OF MIDDLESEX, STATE OF NEW JERSEY, AUTHORIZING THE PRIVATE SALE FOR NOMINAL CONSIDERATION OF A 1974 DUPLEX FRAPP FIRE TRUCK AND ASSOCIATED EQUPMENT TO THE ST. Cranbury Township Resolution # R-08-07-148

 

TOWNSHIP OF CRANBURY

COUNTY OF MIDDLESEX, STATE OF NEW JERSEY

 

A RESOLUTION ESTABLISHING A

SENIOR COMMUNITY CENTER IN TOWN HALL

 

WHEREAS, there is presently no dedicated community center in Cranbury Township to serve the needs of the Township’s senior residents; and

 

WHEREAS, the Township’s Human Services Board has urged the Township to establish such a center; and

 

WHEREAS, the Human Services Board has submitted a proposal to the Township to dedicate a community room in Town Hall for use as a senior center; and

 

WHEREAS, the Township finds that the proposed use of the community room in Town Hall for the afore-mentioned purpose will further the interests of the public, and especially the needs of the Township’s senior residents; and

 

WHEREAS, the Township further finds that the proposed use of the community room will not interfere with or otherwise be detrimental to the day-to-day operations of Town Hall;

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Cranbury, the community room located in the basement of Town Hall be and is hereby designated as Cranbury Township’s Senior Community Center; and

 

BE IT FURTHER RESOLVED, that said community room shall be used exclusively for said Senior Community Center, subject to the terms, conditions and limitations set forth in Exhibit “A” attached hereto and made a part hereof.

RESOLUTION # R 08-07-143

 

RESOLUTION OF THE TOWNSHIP OF CRANBURY

MIDDLESEX COUNTY, NEW JERSEY

 

A RESOLUTION APPROVING CHANGE ORDER NO. 1 TO TOWNSHIP’S REVALUATION CONTRACT WITH APPRAISAL SYSTEMS, INC.

 

            WHEREAS, a revaluation contract was awarded to Appraisal Systems, Inc., (“Contractor”) for $158,000.00 by Resolution 11-05-225; and

 

            WHEREAS, the Tax Assessor has reviewed and approved Change Order No. 1, which would increase the Contract amount by $13,415.00.

 

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Cranbury that:

 

1.                   Change Order No. 1 is hereby approved. 

 

2.                   This Resolution, when counter-signed by Appraisal Systems, Inc., shall serve as an amendment to the original Contract for the purpose of increasing the Contract amount by $13,415.00 and confirming that the new Contract amount, including all change orders, is $171,415.00.

A RESOLUTION APPROVING AN AMENDMENT TO THE MAY 21, 2007 CONTRACT FOR INTERIM MUNICIPAL MANAGEMENT SERVICES ENTERED INTO BETWEEN THE TOWNSHIP OF CRANBURY AND GOVERNMENT MANAGEMENT ADVISORS, LLC

 

WHEREAS, on May 21, 2007, the Township of Cranbury (“Township”) adopted Resolution #R-05-07-100 authorizing the Township to enter into a consulting contract with Government Management Advisors, LLC (“GMA”), which contract was for the provision of interim municipal management services from May 21, 2007 through August 16, 2007; and

WHEREAS, said contract was for a maximum amount of $29,000.00; and

 

WHEREAS, said contract was initially awarded without competitive bidding as a contract below the bid threshold as well as a contract for Extraordinary and Unspecifiable Services; and

WHEREAS, unforeseen circumstances have necessitated an additional and unanticipated expenditure of time, as a result of which the amount of said contract will be exceeded; and

 

 

WHEREAS, GMA estimates that an additional $7,500.00 will be sufficient to cover the additional hours that completing the contract will entail; and

 

WHEREAS, the Township wishes to continue to engage GMA until such time as a permanent Township Administrator has assumed the responsibilities of that office; and

 

WHEREAS, N.J.S.A. 40A:5-1(a) authorizes the Township to award a contract of this nature as a Extraordinary Unspecifiable Service, without the need for competitive bidding; and

WHEREAS, the Chief Financial Officer has certified the availability of funds.

 

NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Cranbury  as follows:

 

1.         The Mayor and Clerk are hereby authorized and directed to execute the attached Amended To Contract For Interim Municipal Management Services, which amendment shall increase the Township's contract with GMA by an amount not to exceed seven thousand five hundred dollars ($7,500).

 

2.         This amendment is being awarded without competitive bidding as an amendment to an “Extraordinary Unspecifiable Services Contract” pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.).

 

3.         A copy of this Resolution and the executed Amendment shall be placed on file in the office of the Township Clerk.

 

3.                   A brief notice of this action shall be published in a newspaper of general circulation in the Township of Cranbury.

A RESOLUTION AUTHORIZING

THE EXECUTION OF AN AGREEMENT WITH GEESE POLICE, INC.

            WHEREAS, the Township of Cranbury requires the services of a contractor to provide goose control services at Village Park as a non-fair and open contract pursuant to the provisions of  N.J.S.A. 19:44A-20.5; and

 

            WHEREAS, the Township wishes to enter into an agreement with Geese  Police, Inc. to provide said services; and

 

            WHEREAS, Geese  Police, Inc. has offered to provide these services to the Township, for the not-to-exceed cost of $­­­­­­­­­­­­­­­­21,000.00; and

 

            WHEREAS, the Township’s Chief Financial Officer has determined and certified in writing that the value of said accounting services will exceed $17,500; and

 

            WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., authorizes the award  of a services contract without competitive bids when the cost of the contract does not exceed the applicable bid threshold; and

 

            WHEREAS, the Chief Financial Officer has certified that there are sufficient funds for this contract.

 

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Cranbury, in the County of Middlesex, as follows:

 

1.         The Mayor and Clerk are hereby authorized and directed to execute an agreement with Geese Police, Inc. to provide goose patrol services at Village Park for the not-to-exceed cost of $21,000.00.

 

2.         A copy of the agreement will be made available for public inspection in the Township Clerk’s office during regular business hours.

 

 

3.         A copy of this Resolution, the Determination of Value, the Business Disclosure Certification, and the executed Agreement shall be placed on file in the office of the Township Clerk.

Cranbury Township Resolution # 08-07-149

 

            WHEREAS, impaired drivers on our nations’ roads kill someone every 30 minutes, 50 people per day, and almost 18,000 people each year; and

 

            WHEREAS, 4% of motor vehicle fatalities in New Jersey are alcohol-related; and

 

            WHEREAS, an enforcement crackdown is planned to combat impaired driving; and

 

            WHEREAS, the summer season and the Labor Day holiday are traditionally times of social gatherings which often include alcohol; and

            WHEREAS, the State of New Jersey, Division of Highway Traffic Safety, has asked law enforcement agencies throughout the State to participate in the Over the Limit Under Arrest 2007 Impaired Driving Crackdown; and

 

            WHEREAS, the project will involve increased impaired driving enforcement from August 17-September 3, 2007; and

 

            WHEREAS, an increase in impaired driving enforcement and a reduction in impaired driving will save lives on our roadways;

 

            THEREFORE, BE IT RESOLVED that Cranbury Township declares its support for the Over the Limit Under Arrest 2007 Crackdown from August 17 – September 3, 2007 and pledges to increase awareness of the dangers of drinking and driving.

            WHEREAS, by resolution dated April 26, 2007, the Cranbury Township Planning Board granted preliminary and final major site plan approval with variance and waivers to Jen-Dar, LLC (“Developer”) for property designated on the Cranbury Township tax maps as Block 2, Lot 10 and located on South River Road; and

 

            WHEREAS, as a condition of said approval, Developer is required to enter into a developer’s agreement with the Township of Cranbury for its fair share contribution to the Township’s sanitary sewer infrastructure; and

 

            WHEREAS, the Township Attorney and Township Engineer have reviewed the agreement submitted by developer, a copy of which is attached hereto as Exhibit “A”, and have recommended that it be approved;

 

            NOW THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Cranbury that the Agreement attached hereto as Exhibit “A” is hereby approved; and

 

            BE IT FURTHER RESOLVED, that the Mayor and Clerk are authorized and directed to execute the Agreement on behalf of the Township of Cranbury, or such substantially similar agreement that has been approved by the Township Attorney and the Township Engineer as to substance and form.

            WHEREAS, as a condition of said approval, Developer is required to enter into a developer’s agreement with the Township of Cranbury for its fair share contribution to the Township’s sanitary sewer infrastructure; and

Reports from Township Staff and Professionals

      Mr. Coughlin, Interim Township Administrator thanked the Township Committee for giving him the opportunity to work with the residents and staff of the Township and stated he looked forward to having a smooth transition with Ms. Smeltzer, the new Township Administrator.  Ms. Waterbury, Township Attorney, reported on a discussion from the last meeting regarding the question if EDAW, Consultants on the new Wright South baseball field, had met their

obligations of their contract with the Township and had provided all items that were required of them.  Ms. Waterbury indicated Mr. Coughlin, Ms. Stave and Ms. Cunningham were able to track the information and Edaw had in fact completed all of the information required and everything appeared to be in order. 

 

Mr. Panconi requested at the next meeting on September 10, 2007, an update from the Township Engineer on the “punch list” items outstanding at the Four Seasons at Cranbury Development (KHov).

Work Session

 a.  Monthly Report From Police Chief  Jay Hansen

Captain Ed Kahler updated (on behalf of the Police Department) the Township Committee for the month of July, 2007.  Captain Kahler indicated there had been 94 summonses issued during the month, 29 for speeding and the remainder for various types of offenses.  The overtime had been due to background investigations taking up a lot of time.  Bike patrol had been run on July 8, 9, 16, 21, 22, 26, 30 & 31st in both the Village area and The Four Seasons.  Captain Kahler indicated there would have been more bike patrol activity, however, there had been a need to assign patrolmen to background investigations.  One violation had been issued in Village Park for a violation of the Board of Health “meat ordinance”.  Mr. Wittman asked if other municipalities were having the same problem in their parks.  Captain Kahler indicated he did not know and Mr. Wittman then asked if he could find out and report back.  Mr. Stannard reported a citizen had approached him a few weeks ago concerning an issue she had in Heritage Park with an unleashed dog.  The dog started to attack her dog and the dog’s owner was able to stop the dog, however, the dog was unleashed.  Mr. Stannard asked that the police patrol the parks in the Township and enforce the leash ordinance if any dogs are unleashed.

    Ms. Stave opened the meeting to public questions and comments on those items not on the agenda.  Mr. Dee Wahlers, 33 Hagerty Lane, asked if any progress had been made on the Environmental Commission’s recommendation to cut the hours of the Geese Police contract.  Mr. Coughlin, Interim Administrator, indicated the Resolution approving the contract on the Agenda is for a lot less hours, and in addition, Mr. Thorne, Public Works Forman would be monitoring Brainerd Lake to determine on a regular basis if there should be a need to have the Geese Police come out more frequently. 

 

Mr. Edward Kietlinski, 83 South Main Street,  spoke concerning his recent increase in property taxes and asked the reason the increase had been so high and what percentage of the tax affects the commercial properties. Mr. Kietlinski also stated the residents had not received enough information from the Township regarding the revaluation.  Ms. Stave responded the Township had Mr. Benner, Tax Assessor, at the last meeting in case any residents had any questions concerning their new tax bills.  However, no residents had shown up.  In addition, there had been an opportunity for residents to appeal their revaluation within a certain time frame in the Spring.  Mr. Wittman offered to have Mr. Benner at the next Township Committee Meeting, if available, on September 10, 2007 to answer any questions.  Mr. Coughlin, Interim Administrator, indicated Mr. Benner had given him some statistics; the commercial had decreased by 1 or 2%. 

Ms. Nancy Kietlinski, 83 South Main Street, stated the problem seemed to be the shock of getting the tax bill with the new rate adjusted back to the beginning of the year.  Ms. Stave responded, by State Statute, the Township is obligated to pay bills, specifically, the School and the County and

there are statutorily-set deadlines for those payments.  The Township has no control over when it gets the numbers from the State and County to send out the tax bills to the residents.  Ms. Kietlinski indicated she did not know how much of the tax bill goes to the School and County.  Mr. Wittman indicated the information is on the tax bills.  Ms. Kietlinski recommended putting the information on the Township’s web site explaining how much of residents’ taxes go for various entities.  Ms. Stave responded there are pie charts on the Township’s web site under the Municipal Budget.  Ms. Stave indicated Mr. Benner would be asked to attend the next Township Committee meeting on September 10, 2007 and in addition, the Clerk will post a notice to residents on the Township’s web site. 

 

Mr. Kallan, Wynnewood Drive, stated he believes residents do not understand what had been done with the revaluation and further stated the purpose was to make all equal.  There being no further comments, the Mayor closed the public part of the meeting.

               BE IT RESOLVED, by the Township Committee of the Township of Cranbury, Middlesex County, New Jersey as follows:

 

               The general nature of the subject to be discussed in this session is as follows:

 

                  ---      Personnel:  Interview of candidates for the position of Cranbury Township Police Officer;

      

                  ---      Personnel:  Discussion of Principal Public Works manager position and salary;

 

  It is unknown at this time precisely when the matters discussed in this session will be disclosed to the public.  Matters involving contract negotiations or the acquisition of land will be disclosed upon conclusion of the negotiations or upon approval of the acquisition.  Matters involving personnel will be disclosed when the need for confidentiality no longer exists.  Matters concerning litigation will be announced upon the conclusion of trial or settlement of that litigation or when the need for confidentiality no longer exists.
